Bettors Den Terms and Condition for Affiliate Partners
The
following Terms and Conditions are for the affiliates and Bettors Den’s
protection and benefit and govern the relationship between the parties and the
services provided by each other. They
form an agreement between us, herein referred to as “The Company”, and its
marketing affiliates.
Please read
the following carefully before submitting an affiliate application.
1.
General Terms and Conditions.
1.1. Applicants are responsible for
acknowledging the Terms and Conditions for our Affiliate Program before
submitting their application and at all times afterward.
1.2. Our Affiliate team may approve,
reject, or close an affiliate account/application at any time and at our sole
discretion. Bettors who are not allowed to wager with The Company for whatever
reason, may not open/run an Affiliate account.
1.3. After approval of the affiliate
application, by using and accessing the affiliate platform, you affirm your
comprehension and agree to these Terms, including all provisions from our Privacy Policy, Sportsbook Rules and Wager Type Rules. If you do not accept these Terms,
kindly refrain from making use of our Affiliate Program as none of our Terms are
negotiable. On a regular basis, we revise, update or amend these Terms, including
any other rules related to the services offered to the members of the site.
Such revisions take immediate effect upon publishing and we will notify
affiliates through our website’s internal messaging system. It is the affiliate’s
responsibility to remain informed on the latest updates to the Affiliate Terms and
Conditions. Continued use of the affiliate program after any modification
implies full acceptance of the revisions or changes applied to these terms.
1.4. The Affiliate and Bettors Den are independent
contractors. Nothing in this agreement will create any kind of partnership,
joint venture, agency, franchise, sales representative, or employment
relationship between the parties.
1.5. We will grant the Affiliate a
non-exclusive, non-transferable, non-sub-licensable, revocable right to use
marketing material as Bettors Den logos, links and our brand name, solely for
the purpose of our marketing affiliate program.
1.6. The Company will offer gaming
related products to members through its brand and it will be responsible for
the entirety of the bettor’s experience, their relation and the funds held in
their accounts. We will be the final decision makers in all matters related to
a member’s account, to our brand, website and the products offered within it.
1.7. It is the Affiliate’s responsibility
to be aware of the laws regarding gambling and its promotion in their jurisdiction,
country, state, or province of origin, as well as in the jurisdictions where
their target market is located. The Company will not be liable for any
indirect, or consequential damages or losses incurred by the affiliate or a member
referred by the affiliate, arising in connection with this agreement or the Affiliate
program.
1.8. The Company reserves the right to
grant, deny, restrict and/or monitor the usage of our XML odds feed and block
IPs or any other of our applications if we determine an incorrect or improper
consumption of the resources.
1.9. The use of the name of our brand to
impersonate Bettors Den or any derivatives of our brand in an Affiliate website
name or URL is not permitted and it shall result in immediate termination of an
Affiliate agreement. The traffic
generated in contravention of these Terms and Conditions will not be
commissionable.
1.10. We require Affiliates, regardless of
their commission type setting, to refer a minimum of five (5) active bettors
within 12 months after opening the Affiliate package and before requesting the
first Affiliate package payout.
1.10.1. If the Affiliate is not capable of
reaching at least 5 active customers within the first 12 months, then the
affiliate account may be closed. If the affiliate account is closed due to not
having the minimum requirement of signups, the accumulated commissions will be
voided and the bettors’ accounts will be removed from the affiliate sheet.
1.11. Affiliate schemes using one or more
players in conjunction with each other will result in affiliate earnings put on
hold until qualified play has been made.
1.11.1. A marketing site with proper traffic
flow should be able to generate more than a few associated accounts over time.
The company does not promote or endorse the creation of affiliate packages with
the intention to have a "quick earn".
1.11.2. Affiliate earnings will be removed
immediately when it is determined the affiliate does not have a legitimate and long-term
commitment to The Company’s Affiliate Program.
1.12. Any attempt of abuse of this program
or improper use of any affiliate accounts will be penalized.
1.13. We do not allow wagering in
Affiliate accounts. If an Affiliate wishes to use The Company’s sportsbook
services or any other of its features as a bettor, the Affiliate CAN NOT do so
through their Affiliate account, winnings, if any, would be forfeited.
1.13.1. If the intention is to take
advantage of all benefits of a Bettors Den member account, the Affiliate must
create a separate bettor account, not associated with their own Affiliate
account.
1.13.2. The Affiliate account holder may not
receive commission from his/her own action using a personal wagering account.
1.13.3. Transfer of affiliate earnings
accumulated in an Affiliate account to a Player Account is considered a payout
and will only be allowed if the Affiliate qualifies for such.
1.13.3.1. An Affiliate may transfer earnings
to its own bettor account once eligible for it.
1.13.3.2. Affiliate earnings that are
transferred to other bettor accounts require a ONE time rollover prior to authorizing
payouts.
2.
Affiliate Marketing Terms and
Conditions.
2.1. The Affiliate must provide exposure
to our brand and services through marketing and advertising efforts using all
their resources to promote our brand to the traffic in their media outlets.
2.2. The banners provided by Bettors Den
are hosted on The Company’s servers and we reserve the right to update these
banners at any time and without previous notice.
2.3. The Affiliate should use the best
commercially reasonable efforts to actively and effectively advertise, market,
and promote Bettors Den as widely and aggressively as possible in order to
maximize the financial benefit to both, the marketing affiliate and The Company.
2.4. It is the Affiliate’s responsibility
to ensure that it is using the correct tracking on their media outlets when
advertising or promoting The Company’s brand.
2.4.1. If an Affiliate believes there has
been a referral member that did not get properly tracked to their affiliate
account, the affiliate must contact our Affiliate team within 24 hours of the
sign-up date with the bettor’s information.
2.4.2. We will manually move the bettor into
the claiming Affiliate package as long as the member did not sign up under a
different Affiliate account.
2.4.3. The Company is not responsible for
commission fees generated from referrals with incorrect or incomplete referral
information.
2.5. If an Affiliate wishes to promote
our brand using a special offer exclusive to their marketing efforts, we require
the terms and conditions of said special offers and the associated marketing
material, to be submitted to our Affiliate team for approval at least one week
in advance. We do not guarantee approval but we will respond to your inquiry
within 48 hours of submission.
2.5.1. If we allow an Affiliate to run an
exclusive offer, bettors would benefit of it only if registering under that
affiliate’s package.
2.5.2. Any winnings produced by an
Affiliate’s exclusive offer will count against the Affiliate commissions.
3.
Affiliate Commission Types.
3.1. The Company will pay the Marketing Affiliate
a commission based on the commission program type selected, being the options:
3.1.1. Revenue Share: A percentage of the
referred bettors’ weekly net losses is paid to the marketing affiliate, minus
all applicable fees.
3.1.2. Cost per Acquisition (CPA): an
amount or percentage on the referred members’ first deposit is paid to the
marketing affiliate, minus all applicable fees.
3.2. The Company will distribute
affiliate revenue or pay the corresponding CPA amount on a weekly basis, every
Monday, through a credit applied to the marketing affiliate account.
4.
Revenue Share Commission Terms.
4.1. We calculate Affiliate Revenue Share
commissions using the following formula:
(Referred Bettors Performance
– Applicable Fees) x Affiliate Commission Percentage
4.2. Any deposit and payout fee generated
by third party processors will count towards the referred bettor’s performance
as a positive figure and we’ll consider it for the weekly commission
application.
4.3. Bettors’ deposits are not guaranteed
by The Company or its processors. Any seizure or loss of inbound or outbound
processed funds before received will count against any Affiliate earnings / bettors
losses.
4.4. Fees generated by certain third
parties (such as Live Dealer and Casino suppliers) will be applied at least
once a month to the Affiliate’s account according to the earnings/losses of the
referred members. The fee application will be proportional to each affiliate’s
commission setting.
4.5. Bettor’s tips to staff members of
the Live Dealer are bettor’s winnings debited as a payout on the third-party
platform that are not accounted for in the account’s overall performance.
Therefore, once a month we will manually apply them to the player’s account as
a positive figure.
4.6. Make-up figures, which are the negative
figures produced by the referred bettors overall positive performance and
proportional to each Affiliate’s commission setting, will carry over to the
following week(s) and will count against payout requests. We require the
Affiliate account to have an available balance of $1000 in excess to their
make-up figure in order to authorize a payout. An amount equal to the make-up
figure must remain in the account until the make-up figure is equal to zero.
4.7. For exceptional cases in which an
Affiliate has more than one account, the makeup figure from each account will
be considered as one for payout purposes.
4.8. Affiliates may request to remove a
bettor’s account from their package in order to avoid having its positive performance
impact their earnings. Once an account is removed from a package, under no
circumstance will it be reinstated.
4.9. An Affiliate will earn commissions for
the lifetime of the bettors that it referred as long as the affiliate remains
an active member of our Affiliate Program and its bettors’ performances make
the affiliate eligible for it.
4.9.1. We consider an Affiliate ACTIVE when
they remain in good standing with us and are currently promoting Bettors Den to
the best of their ability.
5.
Cost Per Acquisition Commission
Terms.
5.1. We pay a 20% Commission for new referrals
on their first deposit.
5.1.1. The minimum qualifying deposit is
$250 and it requires a one-time rollover prior to being eligible for the
payment of the commission.
5.1.2. We pay commissions on a weekly basis
once the conditions are met.
5.2. Fees charged by Payment Service
Providers for new referral’s deposits will also be carried over to the CPA
commission paid to the Affiliate, proportionally to its deposit percentage
setting.
